General Terms and Conditions (GTC) for orders in the AFTERDARK online shop Status: 22.10.2025 (Adapted on 14.11.2025)

1. Scope of Application These GTC apply to all orders placed by consumers (§ 13 BGB) and businesses (§ 14 BGB) via our online shop.

2. 3. Product Range, Own Brand & Print-on-Demand We sell our own brand of textiles (fashion/apparel). Some of our products are manufactured using Print-on-Demand (PoD). Minor production and color-related deviations (e.g., +/- 2 cm dimensional tolerance, minimal color deviations) are technically unavoidable and do not constitute a defect. Please observe care instructions; damage due to improper care does not give rise to warranty claims.

4. Conclusion of Contract Product presentations are non-binding. By clicking "Buy now", you place a binding offer. The contract is concluded by our order confirmation or shipping confirmation via email – whichever comes first.

5. Prices, Shipping Costs, Delivery Area All prices in Euro include statutory VAT. Shipping costs (DE/AT): – Goods value up to €50.00: €3.95 – from €50.00: free shipping (The costs displayed at checkout are decisive.) Delivery countries: Germany and Austria. Delivery time: Production (for PoD) usually 2–5 working days, followed by shipping time depending on the destination country/shipping method.

6. Payment Available payment methods are displayed at checkout (e.g., credit card, PayPal, Sofort/Klarna, Apple/Google Pay). The terms and conditions of the respective payment providers may apply.

7. Retention of Title The goods remain our property until full payment.

8. Statutory Warranty for Defects The statutory warranty for defects applies. For businesses, the duty to inspect according to § 377 HGB applies; limitation period for claims for defects: 12 months from the transfer of risk (except for legally mandatory cases).

9. Exchange & Return Costs Exchanges are only made for valid reasons (e.g., wrong size/wrong purchase within the withdrawal period or defects). Your statutory right of withdrawal of 14 days (Section 11) remains unaffected. Print-on-Demand: Returns/exchanges are generally subject to a charge; the direct return costs are borne by the customer, unless there is a legal defect or we agree otherwise out of goodwill.

10. Liability We are liable without limitation for intent, gross negligence, injury to life, body, health, under the Product Liability Act, and for assumed guarantees. In the event of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage for the contract.

11. Right of Withdrawal for Consumers Consumers have a statutory right of withdrawal of 14 days (see withdrawal policy below). Exclusion of the right of withdrawal for custom-made products: The right of withdrawal does not apply to contracts for the delivery of non-prefabricated goods that are manufactured according to your individual selection or are clearly tailored to personal needs (§ 312g para. 2 no. 1 BGB). This particularly applies to individually personalized PoD articles (e.g., with desired text, special layout).

12. Vouchers Promotional vouchers are time-limited, non-transferable, and cannot be paid out in cash. Gift vouchers are transferable; cash payment is excluded – as far as legally permissible.

13. Copyright and Trademark Rights All designs, logos, product texts, and images are protected by copyright or trademark law. Use only with prior written consent. For designs submitted by the customer, the customer declares to have the necessary rights; they indemnify us against claims by third parties.

14. Data Protection Information on data processing can be found in our data protection policy in the shop.

15. Online Dispute Resolution / Consumer Arbitration Platform of the EU Commission for online dispute resolution: https://ec.europa.eu/consumers/odr/ We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Applicable Law, Place of Jurisdiction German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this only applies insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence. For merchants, the place of jurisdiction is our registered office.
